The following Terms and Conditions of trading with Elite Toys (“us”, “we” or “our”) for the supply of each item (“item”, “product”) to the Customer (“you”, “your” or “recipient”).
The Elite Toys website is owned and operated by Elite Toys (ABN 330 571 224 85).
Use of this website is subject to these Terms and Conditions. Your use of this site signifies your acceptance of these Terms and Conditions. We reserve the right to change the content at any time without notice.
Pricing
All prices of products are in Australian dollars and include GST and are correct at the time of online publication. Prices are subject to change without notice. We will contact you prior to processing the order if there has been a change of price. Payment can be made via Credit Card (Mastercard or VISA) PayPal, Direct Debit, Money Order or cheque – for cheques and money orders, shipping will be delayed until funds have cleared.
Freight is calculated separately at checkout.
Australian Delivery
Please note that all orders are sent via courier service only. All orders should include a daytime delivery address and contact details. Please note that we are unable to accept orders to P.O. Box numbers. Please allow 5-10 days for shipping within Australia. Orders are shipped at the customer’s risk once dispatched by us to the shipper and we accept no liability for the delivery of orders by the shipper. Insurance can be arranged at an additional cost.
Orders can also be picked up. Please specify in comments when checking out.
Delivery Delays
Unforseen supply problems or unexpected demand may occasionally result in stock being unavailable. Should there be a delay in despatching your order we will contact you promptly to advise you of the reason for the delay. You may cancel such an order at any time prior to shipment.
International Ordering
Australian tax (G.S.T.) is removed from all international orders. Please be aware that your order may be subject to local Customs duties and/or local taxes in the country of destination. Please check with your local authority to ascertain applicable rates. Any additional charge must be borne by the recipient.
Warranty,Returns, Refunds & Exchanges
Warranty cover does not include damage caused by normal wear and tear, accidents, misuse, lack of maintenance, neglect or other external causes. Damage also caused by operating the equipment in a manner outside that described in the instructions. The warranty is considered void if the item has been modified, altered or tampered with by a person. If the product is unusable upon receiving or there is a fault, until the nature of any fault is determined, the resolution Elite Toys can offer may vary. Elite Toys may choose to repair or replace the necessary parts, exchange or offer a refund. Where necessary, the item may need to be returned to determine fault/issue.
Elite Toys will gladly refund, credit or exchange products in original sale condition including packaging on presentation of the Elite Toys Online sales docket. Return or Refund is not available if you change your mind, you have damaged the goods, or you knew about a fault beforehand (i.e. factory second). Shipping and handling charges will be refunded only when the return is as a result of our error.
All return requests are to be sent to sales@elitetoys.com.au. Delivery address for returns will be provided with return approval. Elite Toys take no responsibility for goods lost in transit. Where a refund of goods is payable all items are required to be returned by the recipient at their own expense. We recommend that you insure returns for peace of mind.
Upon receipt of the returned goods Elite Toys will process your refund. Refunds will be made to the purchaser in the same form that you used to make the purchase. Where the original payment was made by cheque or money order, please allow up to 21 business days for refunds to be processed.
No returned goods will be refunded without prior agreement between the customer and Elite Toys.
Elite Toys does not offer warranty on any of our products used for commercial purposes. Batteries and chargers are warranted for 3 months.
These Terms and Conditions are governed by and construed in accordance with the laws of the State of New South Wales, or where applicable the laws of the Commonwealth of Australia, and you agree to submit to the exclusive jurisdiction of the courts of that State or, where applicable the Courts of the Commonwealth. There are a number of Australian laws in pertaining to fair trading and privacy including the Trade Practices Act 1974 and the Commonwealth Privacy Act 1988 (with Amendments in 2000).

Elite Toys welcomes feedback and attends to all complaints promptly.

These Terms and Conditions set out the full extent of our obligations and liabilities in respect of the supply of the Items and there are no other conditions, warranties or other terms that are binding on us. Any condition, warranty or other term concerning the items which might otherwise be implied into or incorporated by statute, common law or otherwise (including without limitation any implied term as to fitness for purpose or quality) is excluded.
Nothing in the above paragraph shall restrict, exclude or modify any condition, right, warranty or liability implied into these Terms and Conditions (including any condition, right, warranty or liability imposed by the Trade Practices Act 1974) where to do so is illegal or would render any provision of these Terms and Conditions void. For any liability which cannot lawfully be excluded, but can be limited, our liability is limited to our choice of replacing or paying the cost of replacing the items purchased. Subject to the above 2 paragraphs, we will not be liable for any loss of any kind (including, but not limited to loss of income, loss of profits, loss of contracts, loss of data) or for any indirect or consequential loss or damage of any kind howsoever arising and whether caused by tort (including negligence), breach of contract or otherwise.
Indemnity
You agree to indemnify and keep indemnified, us and our related bodies corporate and their directors, officers, employees, agents and contractors in respect of any claim, liability, loss, damage, cost (including legal cost) or expense which we or our related bodies corporate and their directors, officers, employees, agents and contractors may suffer or incur as a direct or indirect result of your wilful or negligent act or omission with respect to the website (or any part of it) or your breach of these Terms and Conditions.
Website security
All pages on our website are hosted on 128-bit shared SSL security and whilst we make all reasonable endeavours to ensure the integrity and security of the server, we cannot guarantee that the server will be free from unauthorised use or hacking.
Privacy Policy
We at Elite Toys are subject to the National Privacy Principles under the Privacy Act 1988 (and related amendments).
We understand that your privacy is important to you.
